PROPOSED RESOLUTION TO REPEAL THE 22nd AMENDMENT

Franklin Delano Roosevelt was President from 1933-1945. He was elected 4 times. In 1947 the 22nd Amendment was enacted, and was ratified by the required number of states by 1951. This was at least in part to ensure there would never be a dictatorship in the White House.

Section 1. No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once. But this article shall not apply to any person holding the office of President when this article was proposed by the Congress, and shall not prevent any person who may be holding the office of President, or acting as President, during the term within which this article becomes operative from holding the office of President or acting as President during the remainder of such term.

Several times in the last 50+ years congress has tried to repeal the 22nd Amendment. The most recent try was introduced on Jan 6, 2009. It is a frightening thought that if this were to pass and be ratified by the states we could have potentially more than 8 years of the current administration.

This version: Introduced in House. This is the original text of the bill as it was written by its sponsor and submitted to the House for consideration. This is the latest version of the bill available on this website.

H. J. RES. 5

Proposing an amendment to the Constitution of the United States to repeal the twenty-second article of amendment, thereby removing the limitation on the number of terms an individual may serve as President.

IN THE HOUSE OF REPRESENTATIVES

January 6, 2009

Mr. SERRANO introduced the following joint resolution; which was referred to the Committee on the Judiciary

JOINT RESOLUTION

Proposing an amendment to the Constitution of the United States to repeal the twenty-second article of amendment, thereby removing the limitation on the number of terms an individual may serve as President.

Resolved by the Senate and House of Representatives of the United States of America in Congress assembled (two-thirds of each House concurring therein), That the following article is proposed as an amendment to the Constitution of the United States, which shall be valid to all intents and purposes as part of the Constitution when ratified by the legislatures of three-fourths of the several States within seven years after the date of its submission for ratification.
We need to fight this, no President should be allowed to serve more than 8 years, some shouldn't be given that long.
